SewStylers enables designers to sell their patterns on our website and makers to share their projects on our Community pages. The designers and makers are independent third-parties and are not employees, agents, or representatives of SewStylers. They are responsible for ensuring they comply with our Designers’ Terms, Terms of Use and the law, including selling patterns and uploading content which is free from intellectual property infringement.

If there has been a breach of our Designers’ Terms, Terms of Use and/or the law, without limitation to other remedies we may employ, we may limit the designer or makers’ activity, remove or disable access to the material, warn other users of their actions, suspend or terminate their membership or status as a designer or maker and refuse to provide our services to them.

We comply with the Digital Millennium Copyright Act (a US copyright law) (“DMCA”) and the EU Electronic Commerce Directive 2000.  You may use our DMCA notice form to report other breaches of intellectual property, such as breaches of trademarks, whether in the United States or otherwise.

 

Notices of copyright (or other intellectual property) infringement 

Please report any alleged copyright infringement under the DCMA, (and any other intellectual property infringements) to our Designated Agent via our form.

Using our form is the most efficient way for your notice to be processed but if you are unable to use the form, you can send an email to designers@sewstylers.com with the following information:

  1. A physical or electronic signature of the copyright owner or the person authorised to act on behalf of the owner.
  2. Identification of the work(s) allegedly being infringed.
  3. Identification of the material that is allegedly infringing on SewStylers which is specific enough to enable us to find the material (URLs and pattern/project names are helpful).
  4. Your contact information: name, address, telephone number and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are, or are authorised to act on behalf of, the copyright owner.

What we do with the notice

When we receive proper notice that material allegedly infringes the rights of a copyright owner, we will aim to respond quickly to remove or disable access to the material. When we do so, we will contact the affected designer or maker with information about the notice received (and/or provide a copy of the notice including the name and email address of the complainant) and that we have removed or disabled access to the material. We will also provide information on how to submit a counter notice.

 

Counter notice (for DMCA copyright infringement notices only)

If you believe that your material was removed as a result of mistake or misidentification, you can send a counter notice to designers@sewstylers.com with the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location of where that material was before this (URLs of the material location before removal or disabling are helpful).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your contact information: name, address, telephone number and email address.
  5. A statement that you consent to the jurisdiction of the Federal Court for the judicial district in which you are located, or if your address is located outside the United States, for any judicial district in which SewStylers is located, and that you will accept service of process from the person who provided the notification of infringement or an agent of such person.

What we do with the counter notice

We will send the counter notice to the original notice provider and unless the original notice provider informs us that they have filed a court action against you, we will restore access to the material after no less than 10 and no more than 14 business days.
